6. Product suitability and suitability check
6.1. The suitability of a spare part depends on the vehicle's exact model, engine, year of manufacture and VIN code. The product image and name in the online store do not guarantee suitability for a specific vehicle.
6.2. We strongly recommend checking suitability before ordering with our help. To check suitability, send us the vehicle's registration number or VIN code: online store chat, [email protected] or +372 600 1600.
6.3. If you cannot find the spare part you need for your French car in our online store, please contact us - we can most likely source it for you.
6.4. If a customer orders a part without checking suitability and the part does not fit, it is considered a wrongly ordered item. A consumer may in this case use the right of withdrawal (§7), bearing the return shipping costs; for legal persons, §8 applies.
7. Withdrawal from the contract (consumers)
This section applies to consumers (natural persons purchasing outside their economic or professional activity).
7.1. The consumer has the right to withdraw from a purchase made through the online store without giving a reason within 14 days of receiving the goods.
7.2. To withdraw, submit an unambiguous statement:
Via the web form: hmkauto.ee/en/returns (the "Return a product" link is always available in the store footer)
By e-mail: [email protected]
At our premises: Männiku tee 104A, Tallinn
You may use the model withdrawal form, but it is not obligatory.
7.3. The consumer may handle and inspect the goods only to the extent necessary to establish the nature, characteristics and functioning of the goods - in the same way as would be permitted in a shop. Installing the part on a vehicle, putting it into use, starting it, coding it, pairing it with the vehicle (e.g. by VIN code), or any other handling that exceeds what is necessary for inspection, is not part of permitted inspection.
7.4. The consumer is liable for any diminished value of the goods resulting from use or handling beyond what is described in section 7.3.
7.5. HMK Auto has the right to inspect and test the returned goods before refunding, and to deduct the diminished value from the amount refunded. The diminished value may be up to 100% of the value of the goods, including where the goods have been damaged or lost their merchantability during installation or use. This applies in particular, but not exclusively, to the following products:
installed, activated or coded electronics (control units, sensors, etc.);
installed or started assemblies (turbochargers, gearboxes, starters, alternators, pumps, etc.) whose internal damage may not be visible externally.
The extent of the diminished value is assessed on a case-by-case basis, based on the inspection results.
7.6. The right of withdrawal does not apply in the cases set out in VÕS § 53 (4), including where the goods are made or specially ordered from the factory according to the consumer's personal needs (custom order).
7.7. The consumer must return the goods without undue delay, and no later than 14 days from submitting the withdrawal statement. The direct costs of returning the goods (return shipment to HMK Auto) are borne by the consumer.
7.8. HMK Auto refunds all payments made under the contract, including the delivery costs, no later than 14 days from receiving the withdrawal notice. Delivery costs are refunded up to the amount of the cheapest standard delivery method offered by us; any additional cost arising from a more expensive method chosen by the consumer is not refunded. The obligation to refund the delivery cost applies also where the diminished value of the goods is 100% - in that case the consumer is refunded the delivery cost but not the price of the goods.
7.9. The refund is made using the same means of payment used by the buyer, unless the buyer has consented to a different means of payment. No additional costs arise for the buyer from the refund.
7.10. HMK Auto refunds the payment within 14 days. HMK Auto has the right to withhold the refund until the goods have been received back. HMK Auto retains the right to claim from the consumer compensation for the diminished value after receiving and inspecting the goods (see 7.5).
7.11. If the consumer refuses to accept the goods from the courier or parcel machine (except where the parcel is visibly damaged), this is deemed a withdrawal from the contract. In that case the consumer bears the return transport cost, which is deducted from the amount refunded. We recommend notifying us of the intention to withdraw in advance via the website hmkauto.ee/en/returns or by e-mail. If acceptance is refused because the parcel is visibly damaged, this is not a withdrawal and the consumer does not bear the transport cost. In the case of a visibly damaged parcel, the buyer must record the damage immediately upon delivery in the presence of the courier or at the parcel machine, take photos, and notify HMK Auto as soon as possible. Failure to record the damage may make it more difficult to establish the damage and to compensate the purchase.
7.12. Territorial scope and international orders. The 14-day right of withdrawal described in section 7 derives from the EU Consumer Rights Directive and applies to private consumers whose habitual residence is in the European Union or the European Economic Area (EU/EEA). For customers located outside the EU/EEA, returns are possible only by prior agreement. For orders delivered outside the EU, the buyer pays the import taxes, customs and other charges of the destination country. In the event of a return, customs duties, import taxes and international transport costs are not refunded and are borne by the buyer. The contract of sale is governed by Estonian law (see §12.4).
8. Return of goods (business customers)
This section applies to legal persons acting in their economic or professional activity.
8.1. Returns are processed on the basis of a correctly completed return form. The return form must state the reason for the return. Return form.
8.2. HMK Auto has the right to withhold up to 30% of the value of the goods if the return form is incompletely filled in or if the goods were wrongly ordered.
8.3. Requirements for returned goods:
The packaging must be intact and clean

The commercial appearance must be fully preserved
8.4. Already installed spare parts are not bought back.
8.5. HMK Auto is not obliged to buy back goods that have been specially ordered for the customer from the factory or from external suppliers.
8.6. If a business customer refuses to accept the ordered goods from the courier or parcel machine without legal grounds (the goods conform to the contract and are undamaged), the business customer bears both the outbound shipping and the return transport costs. HMK Auto has the right to recover these costs.
8.7. HMK Auto makes any refund to a business customer only after the returned goods have been received and inspected.
9. Return of remanufacturing cores
9.1. Returnable exchange cores must be returned within 10 days.
9.2. The returned part must be externally intact and cleaned, and of the same completeness as the new part.
